These General Terms of Use (hereinafter referred to as the "Terms of Use") are intended to define the conditions of use of the Comories Application (hereinafter the "Application") and the rights and obligations of the Users (hereinafter the "Users") and Comories (hereinafter "Comories").

The publication manager is Mr. Adrien Cens in his capacity as CEO of Comories.

Each User must accept the general terms of use. By using our application, you agree to these terms of use.

If you refuse, please do not use our Application.

By accepting these general terms of use, the User authorizes Comories to subcontract the following services:

Article 2: Definitions

Albums: Grouping of Memories and Users.

Application: Software developed for an electronic device such as a mobile phone, smartphone, or tablet.

User Account: Set of resources and data assigned to a User. A User Account is secured by an identifier and a password.

Personal Data: Any information relating to an identified or identifiable natural person.

Law: Set of legal regulations applicable to digital services and the protection of personal data.

Memories: Set of content (e.g. photos and videos) grouped under a common theme shared by one or more individuals.

Moderator: An individual authorized to review content reported by Users.

Browser: Software that allows the display of websites through searches and the downloading of files.

Newsletter: Periodic newsletter.

User: Person who uses something, a service or a device.

Users: Group of Users.

Visitor: Person who is not yet registered as a User.

1. Evolution and validity of the Terms of Use

The general terms of use have an indefinite duration of validity.

The Comories team reserves the right to modify the clauses of the general terms of use at any time and without justification. In the event of a modification to these Terms of Use, users will be informed by email or through a notification in the application.

2. Acceptance of the Terms of Use

By registering, the User acknowledges having previously read and accepted without reservation all of the present general terms of use. Acceptance of the Terms of Use is confirmed by checking a box during registration, attesting that the user has read and accepted these conditions.

3. Operation of the Application

3.1 Services offered on the Comories Application

The Application called Comories allows Users or the User to access the following services:

• The User can share, personalize, and access content:
  • Share content while choosing the public or private dimension.
  • Access public content.
  • Access private content if the User is the originator of the content or has been invited to collaborate on said content.
  • Search for publicly published content by other Users.
  • Download one or more contents from an Album.

• The User can create social interactions:
  • Communicate with your contacts using the internal messaging service. This is a free service, but data usage may be charged by your operator depending on the user's chosen plan.
  • Like, comment, and share content that the User has access to.
  • Follow other Users through cancelable subscriptions at any time.
  • Search for locations to provide more information about publicly published content via the Places API. Users are then subject to Google's Terms of Use for their location searches.

3.2 User Registration

Visitors to the Application can register to become Users.

On the Comories Application, the User can create an account using a username and a password, the terms of which are defined in section 3.4. The User can also create an account using third-party authentication. The User can also join Comories anonymously and can join Albums using links with variable validity periods (detailed in section 4.2).

Comories reserves the right to suspend a User Account if it is used fraudulently, illegally, or in violation of the general terms of use.

Minors are allowed to register on Comories as long as they have obtained prior permission from their legal guardian(s). Any use of the Application is then subject to the legal guardian(s) of the minor User.

3.3 User Unsubscription

To unsubscribe, the user must access the "Account Settings" section on their profile and select "Delete my account". This action will permanently delete all data associated with the users account.

3.4 User Account

The User is responsible for managing their User Account. The User is solely responsible for the consequences of fraudulent or non-fraudulent use of their User Account. It is prohibited to disclose confidential information such as passwords or private content. Otherwise, the User will be solely responsible for the security and confidentiality of their User Account or content that has been taken out of the private context. The User is responsible for the actions of other Users with whom they have shared an Album.

To ensure the security of the User Account, the password is assumed to be secure. It must contain at least 6 characters. The password must contain at least 8 characters, including an uppercase letter, a lowercase letter, a number, and a special character to ensure an adequate level of security.

In the case where a user joins an Album via a connection link, this allows them, during the validity of the link, to join the specified Album. Public connection links are usable as long as the Album has not reached its User quota.

The user is responsible for any activity carried out under their account. When sharing sensitive content, the user must ensure that the people with whom they share this content also respect the Terms of Use.

4. Data Processing

The User is invited to consult the Comories Privacy Policy

5. Reporting Abusive Content

The Comories Application may include content uploaded by other Users of the Application that the User may find inappropriate or abusive. More details can be found in the privacy policy in section 5.

6. Intellectual Property

The company Comories owns the structure, code, and any element created by the company Comories. These Terms of Use and General Terms and Conditions do not lead to the transfer of intellectual property from Comories to any individual or legal entity, third party, or otherwise.

Any misuse other than that proposed in the Terms of Use and General Terms and Conditions is subject to prior validation by Comories. A request can be made via the address comories@contact.com.

Comories reserves the right to implement a protection system against any system or software aimed at extracting and/or exploiting content that does not belong to it.
